Initial Requirements for Accessing the Service
Before using our services, it is essential that the USER accepts the following provisions by selecting the option "I have read and accept the conditions." Without this prior acceptance, the USER will not be able to access the services offered.
The USER may not use the services or give consent to these provisions if:
- They have not reached the legal age of majority and lack the capacity to establish a binding agreement with We are Psycho, S.L.
- They do not have the legal capacity required to receive the services in accordance with Spanish legislation.
By giving consent to these Terms of Contract, the USER explicitly accepts the Legal Notice, the general conditions of use, and the Privacy Policy of We are Psycho, S.L., available through the following links: Legal Notice and Privacy Policy.

Wearepsycho.com is a digital platform, accessible through devices with internet connection, which provides users with the possibility of receiving psychological care online.
SERVICE PROVISION AGREEMENT
INTERVENING PARTIES:
On one hand, We Are Psycho, S.L., with Tax ID B21836408 and registered office at c/Lepant 270, 08013 Barcelona, hereinafter referred to as the PROVIDER or We are Psycho, S.L.
On the other hand, the natural person whose data appears in the registration form for the services offered by We are Psycho, S.L., hereinafter referred to as the USER or CLIENT.
REPRESENTATIONS:
- We are Psycho, S.L. offers an online psychology platform that provides the client with psychological services through the web portal www.wearepsycho.com.
- The client declares to be of legal age and to have full legal capacity to contract the services offered by We are Psycho, S.L.
- The parties express their interest in formalizing this agreement for the provision of psychological services and the use of the digital platform.
In accordance with the following stipulations:
1. Purpose of the Agreement
The purpose of this agreement is to provide psychological treatment aimed at addressing the specific needs expressed by the client during the consultation.
2. General and Specific Conditions of Service Provision
2.1. Commitments of the PROVIDER
- The PROVIDER will perform the Services according to the terms and conditions established in this Agreement. To this end, the PROVIDER's technical staff will provide continuous collaboration until the conclusion of this Agreement.
- The PROVIDER declares to be the legitimate holder of all property rights over We are Psycho, S.L.
- The PROVIDER will guarantee the quality of the SERVICE with the required professional diligence.
2.2. Commitments of the CLIENT
- The CLIENT assumes exclusive responsibility for evaluating whether the Service offered suits their specific needs.
- The CLIENT agrees to use the service respecting current legislation, in accordance with the terms of this Agreement, and making appropriate and good faith use of it for the contracted purposes.
- The CLIENT must pay the amounts specified in the Third clause.
- The PROVIDER will be exempt from liability for delays, defective compliance, or non-compliance in the provision of Services when these are a consequence of the CLIENT's non-compliance with the obligations established in this Agreement.
IF YOU CONSIDER THAT THERE IS A RISK TO YOUR MENTAL OR PHYSICAL HEALTH, IF YOU CONTEMPLATE SUICIDAL IDEAS OR IF YOU COULD ACT IN A WAY THAT ENDANGERS YOUR INTEGRITY OR THAT OF OTHER PEOPLE, OR IF YOU FACE ANY MEDICAL, PSYCHOLOGICAL OR PSYCHIATRIC EMERGENCY, YOU MUST REFRAIN FROM USING WE ARE PSYCHO, S.L. AND IMMEDIATELY CONTACT A MEDICAL CENTER OR EMERGENCY SERVICE.
3. Aspects Related to Payment of Fees
Assistance is provided through prior payment of fees per session, either individually or through a monthly subscription of 2 and 4 sessions, according to the rates published on the page www.wearepsycho.com
Available Payment Options:
CARD PAYMENT: through the STRIPE payment gateway. All transactions involving the transmission of personal or banking information are carried out in a secure environment, using a server based on SSL (Secure Socked Layer) security technology. All transmitted information travels encrypted through the network. We are Psycho, S.L. will not store your bank card details. Make your payments with VISA or MASTERCARD securely through the Stripe payment gateway. By selecting this payment method, you will be redirected to the banking/financial entity gateway to return to our site once the payment is completed, thus guaranteeing the security of the transaction.
Stripe Payment Processing Service
Payment processing services for users of We are Psycho, S.L. are provided by Stripe and are regulated by the Stripe Connected Account Agreement, which includes the Stripe Terms of Service, collectively referred to as the "Stripe Services Agreement." By accepting these terms or continuing to use We are Psycho, S.L. as a user, you agree to comply with the obligations established in the Stripe Services Agreement, which may be modified by Stripe periodically. For We are Psycho, S.L. to be able to offer payment processing services through Stripe, you agree to provide We are Psycho, S.L. with complete and accurate information about you and your activity, and authorize We are Psycho, S.L. to share this information and transaction data related to the use of payment processing services supplied by Stripe.
4. Term of the Agreement
This agreement shall enter into force from the acquisition of an individual session or a package of multiple sessions and shall have a duration of 1 year, and may be terminated in the following cases:
- By mutual agreement between the parties.
- By We are Psycho, S.L., when the purpose of the agreement has been completed, that is, the completion of the therapeutic session or the complete treatment.
- When the client, unilaterally, considers having reached a sufficient level of improvement that does not require continuing with the service.
- When the client wishes to seek another psychology professional or start a different treatment.
5. Intellectual Property
All contents of the Portal, unless otherwise indicated, are the exclusive property of We are Psycho, S.L. and, by way of example but not limitation, include graphic design, source code, logos, texts, graphics, illustrations, photographs, and other elements present on the Web www.wearepsycho.com. Likewise, all trade names, trademarks, or distinctive signs of any nature contained in the Portal are protected by current legislation.
We are Psycho, S.L. does not grant any type of license or personal use authorization to the User over its intellectual and industrial property rights or over any other right related to its Portal and the services offered.
Therefore, the User acknowledges that the reproduction, distribution, commercialization, transformation, and, in general, any other form of exploitation, by any procedure, of all or part of the contents of this Portal constitutes an infringement of the intellectual and/or industrial property rights of the company or of the holder thereof.
The User is only authorized to use the material available on this Portal for their personal and private use, and its use for commercial purposes or for illicit activities is prohibited.
We are Psycho, S.L. will ensure compliance with the aforementioned conditions, as well as the proper use of the contents presented on its website, exercising all civil and criminal actions that correspond to it in case of infringement or non-compliance with these rights by the User.
6. Liability
Unless otherwise provided by law, We are Psycho, S.L. will not assume liability for the following losses, regardless of their origin:
- Any loss not attributable to breach on its part.
- Business losses (including loss of profits, loss of income, contracts, anticipated savings, data, goodwill, or unnecessary expenses); or any other indirect loss that was not reasonably foreseeable by both parties at the time of formalizing the contract for the acquisition of the products.
Likewise, We are Psycho, S.L. limits its liability in the following cases:
- We are Psycho, S.L. implements all necessary measures to offer a reliable visualization of the service or product on the Portal, however, it is not responsible for minimal differences or inaccuracies that may arise due to limitations in screen resolution, problems with the browser used, or other similar factors.
- Technical failures that, due to fortuitous causes or of another nature, prevent the normal functioning of the service through the internet. Lack of availability of the Portal due to maintenance reasons or other circumstances that make access to the service impossible. We are Psycho, S.L. employs all means at its disposal to facilitate the purchase and payment process, however, it is exempt from liability for causes not attributable to the company, fortuitous events, or force majeure.
- We are Psycho, S.L. will not be responsible for improper use of the services by the User.
In general, We are Psycho, S.L. will not be responsible for any breach or delay in the fulfillment of its obligations when it is due to events beyond its reasonable control, that is, for causes of force majeure, which may include, by way of example but not exhaustive:
- Strikes, lockouts, or other protest measures.
- Civil disturbances, riots, invasions, terrorist threats or attacks, war (declared or not) or threat or preparations for war.
- Fires, explosions, storms, floods, earthquakes, collapses, epidemics, or any other natural disaster.
- Impossibility of using railways, ships, aircraft, motor transport, or other means of transport, public or private.
- Impossibility of using public or private telecommunications systems.
- Acts, decrees, legislation, regulations, or restrictions of any government or public authority.
In this way, the obligations will be suspended during the period in which the cause of force majeure persists, and We are Psycho, S.L. will have an extension in the deadline for compliance equivalent to the duration of the cause of force majeure. We are Psycho, S.L. will employ all reasonable means to find a solution that allows fulfilling its obligations despite the cause of force majeure.
7. Data Protection
To access certain resources of We are Psycho, S.L., Users must previously provide certain personal data (the "Personal Data"). We are Psycho, S.L. will process the Personal Data for the purposes and under the conditions defined in its Privacy Policy and Cookies Policy.
In any case, users guarantee the truthfulness and timeliness of all data that they communicate to We are Psycho, S.L. or through We are Psycho, S.L., being solely responsible for their declarations and for keeping them updated.
8. Confidentiality
We are Psycho, S.L. will maintain confidentiality regarding the information provided by the CLIENT for the execution of the Agreement or that by its very nature should be treated as such. Information disclosed by the CLIENT, that which must be revealed in accordance with current legislation or by judicial resolution or act of competent authority is excluded from the category of confidential information. This confidentiality obligation will be maintained for a period of 5 years from the end of the service.
9. Applicable Law and Jurisdiction
The Contractual Relationship will be governed by Spanish legislation.
Except in cases related to consumers, including Clients who have that consideration, who will follow what is established in the Law, the Users and We are Psycho, S.L. submit, waiving any other jurisdiction that may correspond to them, to the Courts and Tribunals of the city of Barcelona (Spain) for any controversy about the validity, effectiveness, compliance, interpretation, execution, or any other issue related to the Contractual Relationship.
INFORMED CONSENT FOR TREATMENT
This document has been prepared in accordance with the provisions contained in the General Health Law (14/1986 of April 25) and Law 41/2002 of November 14, which regulates rights and obligations regarding information and clinical documentation.
ASPECTS RELATED TO THE CHARACTERISTICS OF THE TREATMENT
Psychological treatment will be provided aimed at addressing the consultation reasons presented.
The therapeutic approach will be adapted to each particular clinical situation and is framed within evidence-based psychotherapy. It will be implemented through various therapeutic strategies: home exercises, recommended readings, questionnaires, records, and any other tool suitable for the intervention objective.
The results of the treatment depend on several factors, including your active participation. To increase the probability of achieving the expected results, it is necessary that you follow the indications and perform the recommended exercises outside the sessions.
Psychological therapy entails both benefits and risks. During the therapeutic process, it is frequently necessary to address painful aspects, which can generate unpleasant or uncomfortable sensations such as discomfort, anxiety, sadness, anger, or frustration, among others. However, evidence-based psychological therapies have demonstrated in numerous scientific studies their beneficial effects for those who complete the process and follow the recommendations. Psychological therapy can achieve a significant decrease in psychological and emotional distress, as well as help increase general levels of life satisfaction and interpersonal relationships, as well as self-knowledge and life awareness. Likewise, it can provide you with specific tools to face new situations, better manage sources of tension or stress, and develop effective strategies for problem-solving.
IF YOU CONSIDER THAT YOUR MENTAL OR PHYSICAL HEALTH IS IN DANGER, IF YOU HAVE SUICIDAL THOUGHTS OR COULD ACT IN A WAY THAT PUTS YOUR INTEGRITY OR THAT OF THIRD PARTIES AT RISK, OR IF YOU BELIEVE THAT ANOTHER PERSON COULD BE IN DANGER, OR IF YOU FACE ANY MEDICAL, PSYCHOLOGICAL OR PSYCHIATRIC EMERGENCY, YOU MUST IMMEDIATELY CONTACT A MEDICAL CENTER OR EMERGENCY SERVICE.
ASPECTS RELATED TO THE DURATION AND MODALITY OF THE TREATMENT
The treatment will be developed with the periodicity established by the professional in charge. The consultations have a standard duration of 50 minutes, although there may be variations according to the circumstances that arise during their development.
The duration of the treatment will be determined by the professional according to the needs derived from the problems that have motivated the intervention.
ASPECTS RELATED TO THE PAYMENT OF FEES
Professional care is carried out through the payment of fees per session, either through individual sessions or through a monthly subscription of 2 or 4 sessions, according to the current rates published on the page www.wearepsycho.com
RESERVATION, CANCELLATION, AND MODIFICATION OF APPOINTMENTS POLICY
- The reservation of an appointment can be made with a maximum of one month in advance.
- If the reservation is made at least 24 hours in advance, the confirmation will be immediate; however, if it is requested with less than 24 hours in advance, the explicit acceptance of the therapist will be necessary, which the patient will receive by email.
- The cancellation of an already confirmed appointment must be made at least 24 hours before the scheduled time for the session, during consultation hours, to allow the reorganization of the agenda without causing harm to the therapist's time or to other patients. Appointments not canceled within this period will incur the full cost of a session.
- When canceling an appointment, the patient must reschedule it. Each previously paid session may be canceled and rescheduled a maximum of three times; once this limit is reached, the session will be definitively canceled.
ASPECTS RELATED TO THE EVOLUTION OF THE TREATMENT
The treatment may be unilaterally interrupted by the patient at the time they deem appropriate, informing the responsible professional of this decision, who will assess whether such interruption could be detrimental to the patient or third parties, reserving the right to notify whomever they deem pertinent.
Confidentiality is guaranteed regarding the information provided by the patient, the limit of which may only be excepted with justified cause in accordance with what is established in the professional code of ethics.
ASPECTS RELATED TO THE CUSTODY OF CLINICAL DATA
The clinical history will be kept in the database for 5 years from the start of the treatment, as required by the aforementioned legislation.
DECLARATION OF CONSENT
I have read the information that has been explained to me about the consent. I have had the opportunity to ask questions about my assessment and treatment.
I grant my consent for the treatment that has been explained to me in a sufficient and understandable manner to be applied to me. I understand that I have the right to reject part or all of the treatment at any time.
I understand my treatment plan and agree to be treated by the general health psychologists who make up the professional team of We are Psycho, S.L. Likewise, I understand that I can revoke my consent at any stage of the treatment.
I declare that I have provided truthfully and honestly the data about my physical and health status that could affect the treatments I am going to receive.
Similarly, within the available clinical options, I express my free, voluntary, and conscious agreement with the treatments about which I have been informed.
